I am not a lawyer, but would it be fair to say that North Face may very well think this lawsuit is ridiculous also? However, to protect itself from a real IP lawsuit, it has to take measures of some kind, otherwise they are leaving themselves open to the argument that they are selective when taking action against someone infringing on their IP?
